Terms
The rules of our relationship, written to be read. What counts is the signed offer: if it says something different from this page, the offer applies.
1. Who we are and who we work for
WeSite, Canton Ticino (“we”), builds and runs websites on subscription for businesses based in Canton Ticino (“the client”).
2. The preview is free
Before any commitment, we build a preview of the website and show it to you. It is free, it doesn’t bind you, and if you’re not convinced, the relationship ends there, at no cost. The preview remains ours until there is a contract: it contains your name and your details, but the work is ours.
3. What the monthly fee covers
- design, copy, build and publication of the website on your domain;
- hosting, certificate, backups and security updates;
- content updates: opening hours, prices, menus, photographs;
- technical maintenance and fixing faults;
- setting up your Google Business Profile and keeping it in line with the website;
- a monthly report with visits, calls and bookings.
Not included, and we say so up front: professional photography, paid advertising (a separate budget, agreed together) and the domain name, which costs a few dozen francs a year and is registered in your name.
“Content updates” means changing what is there. Rebuilding the structure of the website, adding a language or building a new feature is separate work, and we quote for it before we start.
4. Timing
Five working days pass from signing to publication, provided the final content – opening hours, price list, photographs – has arrived. If it arrives later, the five days start from then.
5. Fee, invoicing and late payment
The fee is monthly and fixed, as stated in the offer. There is no deposit. We invoice with a QR-bill or charge your card, as you prefer, and payment is due within 30 days.
If an invoice remains unpaid, we send a reminder. If it remains unpaid for a long time we may suspend the service, but not before telling you in writing and not without at least ten days’ notice: a website that disappears without warning does real damage, and that is not how you treat a client.
6. Duration and cancellation
The subscription runs for one month and renews automatically. You can cancel it by email, effective at the end of the following month: no registered letter needed, and we don’t ask why. The same applies to us.
7. Who owns the website
The content you give us – text, photographs, logo – remains yours. The domain name is registered in your name. When the relationship ends, we hand over the content and leave you the domain.
What remains ours is the way the website is built: the code, the components and the platform we use for all our clients. It isn’t a one-off job done for you, and that’s also why it costs a monthly fee rather than eight thousand francs.
8. What we need from you
We need real content and the right to use it. If you send us a photograph downloaded from the internet and the photographer turns up, the responsibility lies with whoever supplied it. We also need an answer when we ask for something: without one, things take longer, and it’s nobody’s fault.
9. What we don’t promise
We don’t promise Google rankings, a number of customers or a turnover: they depend on too many things we don’t control, and anyone who promises them is selling something else. We promise the work described above, done every month, and the numbers to check it.
We do everything we can to keep the website available at all times, but nobody can guarantee a hundred per cent: interruptions for maintenance or suppliers’ outages can happen, and in that case we respond by putting things right, not by compensating for lost earnings.
10. Changes to these terms
If we change them, we tell you in writing thirty days in advance. If the new terms don’t suit you, you can cancel before they take effect.
11. Applicable law and jurisdiction
Swiss law applies. The place of jurisdiction is Canton Ticino, subject to mandatory places of jurisdiction.
